Can I use third party content on my channel?

According to YouTube's terms of use, the content you submit to the platform must not include third party intellectual property (i.e., copyrighted) unless you have:

- the author’s permission, or

- a legal right to do so.

 

What are the consequences if I use third party content on YT without their permission or without having the legal right to do so?

To ensure compliance with the terms of use, YouTube uses a system called CONTENT ID, which generates a digital fingerprint for each song and video that owners register in the database.

The system constantly compares this database with the content uploaded to YouTube on a daily basis. If it finds matches in any content that has been uploaded, it will notify the copyright owners of that song or video.

A recent example of this involved a YouTuber who used music content from a well-known Japanese brand, for which he received more than 500 copyright claims on the platform.

Consequences

Remember that if Content ID is activated in relation to one of your videos, the owners of the copyrighted content you have used may do one of these 3 things with your video: 1. Block your video; 2. Collect all advertising revenue or 3. Track the video statistics worldwide.

 

In addition to that, YouTube can send you a strike. If you receive 3 strikes, YouTube cancels your account and channel forever.  

 

What does "legal right" mean?

This is commonly known as fair use. However, please note that in Spain we refer to this as: limits or exceptions to copyright.

Remember that, thanks to fair use, if you use clips from copyrighted films or series in your videos, you can do so legally in the following two cases:

a) references, comments, reviews

b) uses for the purposes of caricature, parody or pastiche

What can I do if someone uses my content on YouTube?

You may find out that some user on YouTube uses your copyrighted contents on their channel without your permission, without the legal right to do so, or is freebooting your content. CONTENT ID is quite an effective system developed by YouTube, but please note that YouTube also provides an online form (https://support.google.com/youtube/answer/2807622) for users through which to ask them to remove a specific video or channel for copyright infringement (among other reasons).

 

Freebooting

 

Freebooting is when a user takes a video that you have uploaded to another platform (Facebook, Instagram, others), and uploads it to YouTube without your permission or re-uploads an original video of yours from YouTube on that same platform.

 

 

To access it, you need a YouTube account within YouTube Studio. On the Studio page, on the left, click on "Copyright". Within this section, a tab called "New removal request" will appear on the top right side of the page.

Once there, add the video(s) containing your music/images or video(s), fill in the form with your personal information and select the option to remove the video(s). You can request to have the video removed immediately after filling the form or within 7 days.

If the request is considered valid by YT, the form also enables you to select the option of having identical and similar videos to the one taken down automatically removed from the platform in the future.

The status of your request will appear under the “Copyright” tab in Youtube Studio.
